We have been your trusted source for expert workers compensation defense for nearly 40 years. Your responsibilities under the Medicare Secondary Payer Law are legal obligations. Many of these obligations are framed by State workers’ compensation law.
Our considerable experience with what is covered by Medicare and also what CMS demands in medical allocations, means that Wiedner & McAuliffe is your premier Medicare compliance choice.
Our Technology
As above, we will be registered for online MSA submission as soon as CMS begins the process.
Our Team
Attorneys Robert Smith, Dan Simones, Tim McNally and Nicole Schnoor hold Medicare Set‑Aside Consultant Certified (MSCC) credentials. In addition to lawyers working on Medicare issues, we have a full staff trained in all aspects of Medicare Secondary Payer Law compliance.
When you call or e-mail our team, you get a lawyer who can answer your question. Our policy is that you will receive a response in, or under, one business day.
Our Specialties
Our services give you the confidence to make the right decisions.
Legal Review of a Set-Aside Estimate Prior to CMS Submission
We have saved our clients significant money by applying State law and Medicare rules to the future medical projections fashioned elsewhere as “MSA estimates.”
We review and analyze the estimate you have and, where appropriate, re-work the projections and inclusions using our extensive experience. Recent examples of savings on specific cases:
Innovative allocations: From allocations in settlements that do not meet CMS Review Thresholds to formal WCMSA submissions, we utilize a legal analysis and scrutinize CMS policy to ensure that CMS approves the most conservative WCMSA that adequately considers Medicare’s interests. We have a proven track record of allocations that protect our clients from future inquiry by Medicare, while saving them thousands of dollars on unnecessary and/or unrelated future medical costs.
We maintain a strong record of properly submitted WCMSA proposals, thereby limiting the risk for delay created by a request for additional information from CMS.
